Terms of Service

1. Agreement to Terms

By accessing or using ScoodaNow.com ("Scooda," "the Platform"), operated by JayNona Enterprises, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. What Scooda Does

Scooda is a technology platform that connects buyers of large marketplace items with independent local delivery drivers ("Scooder Drivers"). Scooda is not a moving company or transportation carrier. We facilitate connections and provide payment processing, tracking, and coordination tools.

Scooder Drivers are independent contractors, not employees of JayNona Enterprises.

3. User Accounts

You must be 18 or older to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information — false information may result in account termination.

4. Buyers

As a buyer, you agree to:

• Provide accurate dropoff address and access information
• Be available or arrange access at the time of delivery
• Pay the stated delivery fee at the time of booking
• Not request services outside the scope of the delivery

Payment is charged at booking. Your payment is held until delivery is confirmed. Scooda does not process payment for the marketplace item itself — only the delivery fee.

5. Sellers

As a seller, you agree to:

• Provide accurate item descriptions, dimensions, and pickup location
• Have the item ready and accessible at the agreed pickup time
• Not misrepresent item weight, fragility, or access conditions
• Ensure you have the legal right to sell and transfer the item

6. Scooder Drivers

As a Scooder Driver, you agree to:

• Maintain valid driver's license and auto insurance at all times
• Handle all items with reasonable care
• Upload required pickup and delivery photos
• Complete accepted jobs or provide timely notice of cancellation
• Operate as an independent contractor — not an employee of Scooda
• Be responsible for your own taxes on earnings

Scooda reserves the right to suspend or terminate driver accounts for violations, poor ratings, or failure to meet platform standards.

7. Payments and Fees

Delivery fees are calculated by Scooda's pricing engine and shown to buyers before payment. The platform fee is embedded in the delivery price and not shown as a separate line item.

Tips are 100% passed through to Scooder Drivers. Driver payouts are released after delivery photo confirmation. Scooda processes payments via Stripe.

Refunds: Refunds may be issued at Scooda's discretion in cases of non-delivery, significant damage, or misrepresentation. Contact support@scoodanow.com within 48 hours of the delivery.

8. Prohibited Conduct

You may not use Scooda to:

• Transport illegal items, hazardous materials, or weapons
• Harass, threaten, or harm other users
• Provide false information or impersonate others
• Circumvent Scooda's payment system
• Scrape, reverse engineer, or copy the platform

9. Limitation of Liability

Scooda provides a technology platform to facilitate connections. We are not liable for:

• Damage to items during delivery beyond what our dispute process covers
• Actions or omissions of independent Scooder Drivers
• Losses arising from delivery delays
• The quality, safety, or legality of items being delivered

Our maximum liability to you shall not exceed the delivery fee paid for the specific transaction in dispute.

10. Dispute Resolution

For delivery disputes, contact support@scoodanow.com within 48 hours with photos and details. We review all disputes within 3 business days. Disputes not resolved informally shall be submitted to binding arbitration in the state of Florida under AAA rules.

11. Termination

We reserve the right to suspend or terminate any account at our discretion, with or without notice, for violations of these terms or for any reason we determine is harmful to the platform or its users.

12. Governing Law

These Terms are governed by the laws of the State of Florida. Any legal action shall be brought in the courts of Polk County, Florida.
